These Terms of Service ("Terms") govern your access to and use of the Comments Studio service, website, and dashboard (collectively, the "Service") operated by Comments Studio ("we", "us", "our"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. The Service
Comments Studio is an AI-powered Instagram comment moderation tool designed for creators. The Service connects to your Instagram Business or Creator account via Meta's official Graph API and helps you automatically hide unwanted comments (predatory patterns, vulgar language, spam, custom blocked keywords), reply to genuine comments in a tone you select, like genuine comments, and generate audience insights from comment data.
The Service does not post original content, send direct messages without your explicit instruction, or block, mute, or report Instagram users on your behalf. We hide comments — we do not delete them. You can review and restore any hidden comment from your dashboard.
2. Eligibility
To use the Service, you must:
- Be at least 18 years old.
- Own or be authorised to manage the Instagram account(s) you connect.
- Have an Instagram Business or Creator account linked to a Facebook Page you administer.
- Comply with Meta's Platform Terms, Instagram's Community Guidelines, and all applicable laws.
3. Account registration
You authenticate via Meta OAuth. You are responsible for maintaining the security of the Facebook and Instagram accounts you connect, and for all activity occurring under your Comments Studio account. Notify us immediately at support@commentsstudio.com if you suspect unauthorised access.
4. Plans and pricing
4.1 Free plan
The free plan permits processing of up to 1,000 comments per calendar month. Quota resets on the first day of each calendar month. Unused quota does not roll over.
4.2 Pro plan
The Pro plan is offered at ₹299 per month (billed monthly) or ₹199 per month (billed annually as ₹2,388 per year). Pro includes up to 50,000 comments per month, AI-generated replies in six tones, audience insights, custom keyword blocking, support for one Instagram account, and email + chat support. Prices are inclusive of any applicable GST.
4.3 Pro+ plan
The Pro+ plan is offered at ₹999 per month (billed monthly) or ₹799 per month (billed annually as ₹9,588 per year). Pro+ includes unlimited comment processing, up to three Instagram accounts, unlimited VIP fans, WhatsApp priority support, and early access to new features. Prices are inclusive of any applicable GST.
4.3 Quota counting
One quota unit is consumed per processed comment, regardless of the action(s) taken on it (hide, like, reply, or no action). Quota counting is performed at the time the comment enters our processing queue.
4.4 Free trial
First-time Pro subscribers may be offered a 7-day free trial. If you do not cancel before the trial ends, your selected billing cycle commences automatically. You may cancel at any time during the trial with no charge.
4.5 Price changes
We may revise pricing from time to time. Existing subscribers will be notified at least 30 days before any price increase takes effect at their next renewal.
5. Payments
Payments are processed by Razorpay Software Private Limited. By subscribing, you authorise us to charge your selected payment method (UPI, debit/credit card, netbanking, or wallet) on a recurring basis until you cancel. You agree to Razorpay's terms in addition to ours.
If a payment fails, we will attempt to retry within 7 days. If unsuccessful, your subscription will be downgraded to the free plan; you will retain access to your data but processing capabilities will be limited.
6. Cancellation and refunds
You may cancel your Pro subscription at any time from your dashboard. Cancellation takes effect at the end of your current billing period; you will continue to have Pro access until then. We do not provide partial refunds for unused time within a paid period.
7-day refund for first-time annual subscribers: if you purchased an annual subscription for the first time and are not satisfied, contact support@commentsstudio.com within 7 days of the original purchase for a full refund. This does not apply to renewals or to monthly plans.
7. Acceptable use
You agree not to:
- Use the Service to violate Meta's Platform Terms, Instagram's Community Guidelines, or any applicable law.
- Connect Instagram accounts you do not own or are not authorised to manage.
- Use the Service to harass, defame, or discriminate against any individual or group.
- Suppress legitimate criticism, dissent, journalistic inquiry, or whistleblowing.
- Use the Service to engage in or facilitate spam, scams, or fraudulent activity.
- Reverse engineer, scrape, or attempt to extract source code or proprietary logic from the Service.
- Resell, sublicense, or otherwise commercially exploit access to the Service without our written consent.
- Submit deliberately misleading custom keywords intended to manipulate political, electoral, or public-health discourse.
- Use the Service in a manner that exceeds reasonable usage limits or impairs the Service for other users.
We reserve the right to suspend or terminate accounts that violate these provisions.
8. AI and accuracy disclaimer
The Service uses machine-learning models and large language models to classify comments and generate reply text. These systems are probabilistic and not perfect. False positives (genuine comments incorrectly hidden) and false negatives (harmful comments not detected) can and will occur.
AI-generated replies are sent from your Instagram account and appear to be authored by you. You bear responsibility for the public visibility of these replies. You may review the AI reply configuration and disable auto-replies at any time. You can also review any reply sent and delete it from Instagram if needed.
The Service is provided as a moderation aid, not as a substitute for human judgement. We recommend periodically reviewing the "Hidden Comments" section of your dashboard.
9. Your content and licence
You retain ownership of your Instagram content, comments processed through the Service, and your moderation configuration. You grant us a limited, non-exclusive, royalty-free, worldwide licence to process this data solely for the purposes of providing the Service to you. This licence terminates when you delete your account.
10. Our intellectual property
All software, designs, models, branding, documentation, and other materials comprising the Service are the intellectual property of Comments Studio or our licensors. Except for the limited right to use the Service granted under these Terms, no rights are transferred to you.
11. Service availability
We strive to keep the Service available but do not guarantee uninterrupted access. The Service depends on third parties (Meta Graph API, payment processors, hosting providers) whose outages are outside our control. We may perform scheduled maintenance with reasonable notice. We accept no liability for downtime caused by third-party outages, force majeure events, or your own equipment or network failures.
12. Termination by us
We may suspend or terminate your account immediately, with or without notice, if you breach these Terms, if your use creates risk for us or other users, if Meta revokes our API access in relation to your account, or if we are required to do so by law.
On termination by you or us, you will retain access to your data for 30 days to export it, after which it will be deleted in accordance with our Privacy Policy.
13. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, UNINTERRUPTED, OR THAT ITS MODERATION DECISIONS WILL ALWAYS BE ACCURATE.
14. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR ₹1,000, WHICHEVER IS GREATER.
IN NO EVENT WILL WE BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, OR REPUTATIONAL HARM, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
15. Indemnification
You agree to indemnify and hold Comments Studio harmless from any claims, damages, or expenses (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Service, or your violation of any third-party rights.
16. Governing law and disputes
These Terms are governed by the laws of India, without regard to conflict-of-laws principles. Any dispute arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts at Chandigarh, India.
Before initiating formal legal proceedings, you agree to first contact legal@commentsstudio.com and attempt to resolve the dispute in good faith for at least 30 days.
17. Changes to these Terms
We may revise these Terms from time to time. Material changes will be communicated via email and via a notice on the dashboard at least 7 days before they take effect. Your continued use of the Service after the effective date of the revised Terms constitutes acceptance of the changes.
18. Miscellaneous
- Entire agreement: these Terms and our Privacy Policy constitute the entire agreement between you and us regarding the Service.
- Severability: if any provision is held unenforceable, the remaining provisions remain in full effect.
- No waiver: our failure to enforce any right or provision is not a waiver of that right or provision.
- Assignment: you may not assign these Terms without our written consent. We may assign these Terms to a successor in connection with a merger, acquisition, or sale of assets.
